These purchase terms apply when buying goods and custom works on the websites lala.lt and lalaportrait.com.

By using the website and placing an order, you confirm that you have read these terms and agree to abide by them.

1. General Information

LALA is a creative studio that creates personalized portraits, caricatures, paintings, and other custom artistic works based on photos, ideas, and descriptions provided by the client.

The website operates on the Shopify platform. Payments are processed through Shopify Payments and other available payment methods on the site.

2. Products and Custom Orders

On the website, you can purchase:

• watercolor portraits from a photo;

• caricatures and cartoons;

• personalized paintings based on your vision;

• custom artistic orders;

• other creations or products from the LALA studio, if available on the site.

Some products are created individually based on the information you provide. Such works begin with your photos, description, chosen style, format, and other order details.

3. Placing an Order

When placing an order, you must provide accurate contact, delivery, and order information.

If photos, descriptions, or additional details are needed for the order, please provide them as clearly as possible. The more information you provide about the person, occasion, place, mood, or desired outcome, the more accurately we can fulfill your vision.

LALA reserves the right to contact you for additional information if it is lacking for the order's completion.

4. Photos and Client-Provided Material

By submitting photos or other materials, you confirm that you have the right to use them and provide them for the creation of a custom order.

You agree that LALA may use your submitted photos, descriptions, and other information solely to create your ordered work, contact you about the order, and complete the purchase.

If the submitted photo is of very poor quality or the person, pet, place, or details are unclear, the final result may differ from your expectations. In such cases, LALA may request additional photos.

5. Creative Interpretation

Personalized works are not exact copies of photos. They are artistic interpretations where the mood, character, and overall feeling of the person, place, moment, or idea are most important.

Colors, composition, details, and the final image may slightly differ from the photo or your imagination, as each work is created individually and depends on the chosen style, provided material, and creative decision.

6. Prices and Payments

All prices are provided alongside specific products on the website.

The order is processed only upon receipt of payment, unless otherwise agreed individually.

Payments are made through the payment methods available on the Shopify platform. LALA does not store your payment card details.

If a technical error displays an incorrect price on the website, LALA reserves the right to contact you and offer to confirm the order at the correct price or cancel it.

7. Order Fulfillment Time

Each personalized work is created individually, so the production time may vary depending on the complexity of the order, workload, format, and required details.

An estimated time may be indicated on the product page, during the order, or via email. If timing is crucial for you, such as needing a gift by a specific date, please indicate this before placing the order or in the order comment.

LALA strives to meet the indicated deadlines but cannot be held responsible for delays caused by inaccurate client information, late submitted photos, delivery service providers, or other circumstances beyond LALA's control.

8. Order Modification and Cancellation

If you wish to change the order information, please contact us as soon as possible via email hello@lalaportrait.com.

If the work has not yet begun, changes can usually be made without an additional fee.

If the work has already started or is completed, changes may not be possible or may incur additional costs, depending on the extent of the changes.

A custom order can be canceled only if the work has not yet begun. If the creative process has started, the order is generally non-cancellable unless otherwise agreed individually.

9. Returns and Right of Withdrawal

According to applicable consumer rights regulations, consumers generally have the right to withdraw from a distance contract within 14 days, but this right does not apply to goods made according to individual consumer specifications or clearly tailored to personal needs.

For this reason, personalized portraits, caricatures, paintings, and other works created from your photos, idea, or description are non-returnable and cannot be withdrawn from once the work has begun, unless the work is defective, damaged, or does not meet the confirmed order conditions.

If you purchase a non-personalized, standard product that is subject to return rights, you can contact us via email hello@lalaportrait.com within 14 days of receiving the product.

The returned product must be unused, undamaged, and, if applicable, in its original packaging. The direct costs of returning the product are borne by the buyer, unless otherwise agreed or provided by law.

10. Damaged or Poor Quality Goods

If you receive a damaged, defective, or poor-quality product, please contact us via email hello@lalaportrait.com as soon as possible after receiving the shipment.

In your email, please include the order number, briefly describe the situation, and attach clear photos showing the damage or issue.

If the problem is confirmed, LALA may offer an appropriate solution: repair, replacement, partial or full refund, depending on the situation.

11. Delivery

Delivery methods, prices, and times are provided at checkout or on the product page.

The buyer is responsible for providing the correct delivery address and contact details. If the shipment is returned due to an incorrect address, failure to collect, or other buyer-related reasons, the costs of reshipping may be borne by the buyer.

LALA is not responsible for delivery delays caused by couriers, postal services, holiday periods, inaccurate delivery data, or other circumstances beyond LALA's control.

12. Intellectual Property

All texts, photos, illustrations, product descriptions, design elements, and works presented on the LALA website belong to LALA or are used legally.

By purchasing a personalized work, you receive a physical or digital piece for personal use, but the copyright to the work remains with the creator, unless otherwise agreed in writing.

Without written consent from LALA, it is prohibited to copy, resell, use for commercial purposes, print on other products, use in advertising, logos, trademarks, or other commercial projects.

If you wish to use the work for commercial purposes, please contact us separately.

13. Use of Works in Portfolio

LALA respects client privacy. Personalized works that clearly depict private individuals or personal information are used publicly in portfolios, social media, or advertising only with separate consent or by removing identifying information if appropriate for the specific case.

If you do not wish for your order to be shown publicly in any form, you can indicate this in the order comment or via email.

14. Prohibited Content

LALA reserves the right to refuse to create a work if the submitted idea, text, or visual material is illegal, offensive, discriminatory, incites hatred, violates others' rights, or is related to violence, pornographic content, or other material that does not align with LALA's values.

In such cases, the order may be canceled, and the paid amount refunded if the work has not yet begun.

15. Limitation of Liability

LALA strives to ensure that the information on the website is accurate, clear, and up-to-date, but cannot guarantee that the website will always operate without technical disruptions or errors.

LALA is not responsible for losses arising from improper use of the website, incorrectly provided client information, third-party service disruptions, or circumstances beyond LALA's control.

16. Privacy

Personal data is processed according to LALA's privacy policy, which is available on the website.

By placing an order, you agree that your data will be used for order acceptance, payment, creation, delivery, and customer service.

17. Changes to Terms

LALA reserves the right to update or change these purchase terms at any time. The latest version of the terms is always available on the website.

The terms applicable to an order are those in effect at the time the order is placed.

18. Dispute Resolution

If you have questions, complaints, or wish to discuss an order, please first contact us via email hello@lalaportrait.com. We will strive to respond and find a solution as soon as possible.

If a dispute cannot be resolved amicably, the consumer has the right to contact the State Consumer Rights Protection Authority in accordance with the laws of the Republic of Lithuania.
